Privacy statement
Bascom processes personal data to handle your order, to advise and support you, and to improve our website and marketing. This statement explains which data we process, why, how long we keep it, who we share it with and what rights you have under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
1. What is personal data?
Personal data is any information that can be traced directly or indirectly to a person. This includes your name, email address, phone number and address, but also your IP address or how you browse our website.
If you order on behalf of a company, the company's own details are not personal data. Your name and contact details as the contact person are, as are the details of a sole trader.
2. What personal data do we collect and why?
Which data we process depends on how you get in touch with us. Each type of processing has a lawful basis under the UK GDPR and a fixed retention period.
A. When you visit our website
Our website uses functional cookies that are needed for the webshop to work. We only place analytics and marketing cookies once you have given your consent. With these cookies we:
analyse how visitors use the website, so that we can improve it;
measure the results of our advertising;
show you relevant advertisements on other platforms.
For this we work with:
Google, for website statistics and advertising (privacy policy);
Microsoft, for advertising in Bing (privacy statement);
OpenAI, for advertising in ChatGPT (European privacy policy, which also applies to the UK);
Mouseflow, to analyse clicks, scrolling and mouse movements on our website. What you type into form fields is not recorded (privacy policy).
Lawful basis: consent. You can withdraw or change your consent at any time via the 'Cookie preferences' link at the bottom of the website. Retention period: cookies last for a maximum of 1 year. We keep analytics data for a maximum of 14 months.
B. When you contact us or ask for advice
When you contact us via our contact form, by email or by phone, we may process the following personal data:
first name and surname;
email address;
phone number;
the content of your message.
Lawful basis: taking steps to enter into or perform a contract, so that we can answer your question and advise you. Retention period: if you are a customer, we keep this data for up to 7 years after our last contact. This means we have your previous questions and arrangements to hand if you contact us again later, and this period is in line with the one for your order details. If you are not (yet) a customer, we keep it for a maximum of 1 year after our last contact.
C. When you request a quote
If you request a quote from us, we may process the following personal data:
first name and surname;
email address;
phone number;
address details.
Lawful basis: taking steps to enter into a contract (to prepare a tailored proposal at your request). Retention period: we keep quotes that do not result in an order for a maximum of 1 year for possible follow-up.
D. When you place an order
If you order via the webshop, by phone or by email, we process:
name and company name;
email address and phone number;
address details;
payment details, depending on the payment method you choose;
IP address.
Payments are handled by our payment provider. We do not store credit card details ourselves.
Lawful basis: performance of the contract and a legal obligation (Dutch tax law). We use the IP address to prevent fraud; the lawful basis for this is our legitimate interest. Retention period: we keep order, invoice and accounting records for 7 years, as required by Dutch tax law.
3. Who do we share your personal data with?
We only share personal data when this is necessary to perform our contract with you, when the law requires us to, or when you have given your consent. We never sell your data. The recipients fall into these categories:
IT and software suppliers, for hosting, the webshop, email, customer service and data storage;
payment providers, to process payments securely;
carriers, to deliver your order;
installation partners, if you engage an installer through us;
financial service providers, for bookkeeping and accounting;
marketing and advertising partners, only with your consent (see 2A).
Parties that process data on our behalf do so under a data processing agreement. This sets out security and confidentiality requirements, and they may not use your data for their own purposes.
Some suppliers are based outside the United Kingdom and the European Economic Area (EEA), for example in the United States. Data is only transferred to such a party if appropriate safeguards are in place, such as the UK Extension to the EU-US Data Privacy Framework or the International Data Transfer Addendum to the European Commission's standard contractual clauses.
4. How do we protect your data?
We take appropriate technical and organisational measures against loss and unauthorised access:
the entire website uses an encrypted HTTPS connection;
data is stored in secure, certified cloud environments;
only employees who need the data for their work have access to it, protected by multi-factor authentication;
we regularly check our systems for vulnerabilities.
5. Automated decision-making
We do not make decisions about you that are made solely by a computer and that have legal or similarly significant effects for you. If you consent to marketing cookies, advertising platforms do create a profile in order to show you relevant advertisements (see 2A).
6. What are your rights?
Under the UK GDPR you have the following rights:
Access: you may ask which personal data we process about you.
Rectification: you can have incorrect or incomplete data corrected.
Erasure: you can ask us to delete your data, unless we are legally required to keep it, such as order details for 7 years.
Restriction: you can ask us to temporarily stop using your data.
Portability: you can request your data in a structured, commonly used and machine-readable format.
Objection: you can object to processing based on our legitimate interest.
Withdrawal of consent: you can withdraw consent you have given, for example for marketing cookies, at any time.
Send your request to bascom@hypernode.io. We may ask you to identify yourself, so that we are sure we are giving data to the right person. We will respond within two weeks.
7. Complaints
If we cannot resolve an issue with you, you can lodge a complaint with the supervisory authority:
in the United Kingdom: Information Commissioner's Office (ICO)
